All agreements and commitments of Antwerp Powerchairhockey Collective VZW are governed by Belgian law.
7. Other Provisions
Antwerp Powerchairhockey Collective VZW reserves the right to modify, extend, remove, limit, or interrupt the website and its services at any time, without prior notice and without liability.
If you violate these GTC, Antwerp Powerchairhockey Collective VZW reserves the right to take appropriate actions and seek compensation, such as temporarily or permanently denying you access to the website or services. These measures can be taken without providing reasons and without prior notice. II. General Terms and Conditions of Sale
1. Scope
These General Terms and Conditions of Sale (“GTC”) define the mutual rights and obligations when you, as a “Client,” purchase products or services on our website.
By placing an order, you are deemed to accept these GTC without reservation; otherwise, your order will not be validated.
We may make exceptions to these GTC in certain cases, provided they are agreed upon in writing. Such exceptions may involve modifying, adding to, or removing the relevant provisions and will not affect the application of the remaining GTC.
Antwerp Powerchairhockey Collective VZW reserves the right to amend these GTC from time to time. Any amendments will be applicable to purchases made after they are published online.
2. Online Store
Through our website, we provide an online store showcasing the products or services we sell. Please note that the pictures provided do not have contractual value.
Products and services are described and presented with the utmost accuracy. However, we cannot be held responsible for errors or omissions in the presentation. Products and services are offered subject to their availability.
Prices are listed on the website. Antwerp Powerchairhockey Collective VZW is exempt from VAT.
3. Price
We reserve the right to change our prices at any time by publishing them online. Only the prices and taxes in effect at the time of your order will apply, subject to availability on that date.
Prices are indicated in euros and do not include any delivery costs, which will be shown and invoiced before you finalize your order. The total amount of your order, including delivery costs (if applicable), will be displayed before final validation.
4. Online Ordering
You can place an order online using an electronic form. By completing the electronic form, you accept the price and description of the products or services.
To validate your order, you must accept these GTC by clicking in the designated area. You must provide a valid email, address, valid billing information, and, if applicable, a valid delivery address. All communication with us will take place through info@aphcollective.be.
Additionally, you must choose your delivery method and validate your payment method.
We reserve the right to block your order in case of non-payment, an incorrect address, or any other problem with your account until the issue is resolved.
5. Order Confirmation and Payment
We retain ownership of ordered items until full payment for the order is received.
Payment
You make payment at the time of final validation of your order using your chosen payment method. This validation serves as your signature.
You guarantee that you have the necessary authorizations to use your chosen payment method and acknowledge that the information provided for this purpose constitutes proof of your agreement to the sale and payment of the amounts due. We have a procedure to verify orders and payment methods to reasonably protect against fraudulent use of a payment method, including by requesting identification information from you.
In case of a refusal of payment by credit card from accredited organizations or non-payment, we reserve the right to suspend or cancel the order and its delivery. We also reserve the right to refuse an order from a client who has not completed all or part of a previous order or with whom a payment dispute is pending.
Confirmation
Upon receiving confirmation of your purchase and payment, we will send you a purchase confirmation and an invoice, unless the invoice is provided with the order itself.
You may request that the invoice be sent to an address different from the delivery address by contacting Customer Service before delivery (see contact details below).
In case a service or product is unavailable, we will inform you as soon as possible info@aphcollective.be, proposing a replacement or cancellation of the order for that product and, if applicable, a refund of the corresponding price. The remainder of your order will remain fixed and final.
6. Proof of Transaction
Communications, orders, and payments between you and us can be proven by computerized records, which are kept in our computer systems under reasonable security conditions. Orders and invoices will be archived on a reliable and durable medium and will serve as evidence.
7. Delivery
Delivery occurs only after payment is confirmed by our bank.
Products are delivered to the address you provided on the online order form. Any additional costs resulting from incomplete or incorrect information provided by you will be charged to you. For availability reasons, an order may be delivered in several successive shipments.
Delivery takes place, according to the method you choose, within the following timeframes:
- Standard delivery: 6-8 days
Delivery times are indicative. In case of late delivery, no compensation can be claimed from us or the carrier. However, if delivery occurs more than thirty days after the agreed date, the sales contract may be terminated, and you may be reimbursed.
Order Verification
Upon receiving the products, you or the recipient must check the condition of the delivered product or the conformity of the delivered service.
If one or more ordered products are missing or damaged, you or the recipient must note the necessary reservations with the carrier at the time of delivery and notify us immediately. Verification is deemed complete once you or an authorized person has accepted the order without reservations.
Any reservation not made according to the rules defined above and within the set deadlines cannot be considered and releases us from any liability to you.
Delivery Error
In case of a delivery error or non-conformity of the products with the information on the order form, you must notify us within three working days from the delivery date. Any complaint not made within this deadline cannot be considered and releases us from any liability to you.
8. Returns and Exchanges (Products)
Overview
Our refund and returns policy lasts 14 days. If 14 days have passed since your purchase, we cannot offer you a full refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Certain types of goods, such as tournaments and camps, have different return policies and cannot be returned. More information is provided below under “Events.”
To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.
Partial refunds may be granted in certain situations:
- Any item not in its original condition, damaged, or missing parts for reasons not due to our error.
- Any item returned more than 14 days after delivery.
Exchange
We only replace items if they are defective or damaged. If you need to exchange an item for the same one, please email us at info@aphcollective.be and send your item to: Knotwilgstraat 5, 2950 Kapellen, Belgium.
Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver, and they will be informed of your return.
Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also inform you whether your refund is approved or rejected.
If approved, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment within a certain number of days.
Shipping Returns
To return your product, you should mail it to: Antwerp Powerchairhockey Collective VZW, Knotwilgstraat 5, 2950 Kapellen, Belgium. You will be responsible for paying your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on your location, the time it takes for your exchanged product to reach you may vary. If you are returning more expensive items, consider using a trackable shipping service or purchasing shipping insurance. We do not guarantee that we will receive your returned item.
9. Conformity Guarantee
We guarantee that products or services conform to the contract in accordance with the legislation in force at the time of the contract’s conclusion.
If you are a consumer, we offer a legal warranty period of two years from the delivery of the product. For second-hand goods, the warranty period is one year.
Any lack of conformity must be reported to us as soon as possible, and in any case, no later than two months after its discovery.
10. Right of Withdrawal
If you are a consumer, you can exercise your legal right of withdrawal within 14 days after the delivery of goods or the conclusion of a service agreement.
After notifying us of your decision to withdraw, you then have 14 days to return the goods. Any withdrawal not carried out according to the rules and deadlines of this article cannot be considered and releases us from any liability to you.
You may request a refund for the returned product at no additional cost. The return or exchange of a product can only be accepted if the products are whole, intact, and in their original condition, particularly with complete, intact packaging and in a resalable state.
We will refund all amounts paid, including delivery costs, within 14 days of receiving the returned goods or notification of proof of return.
If all or part of the order relates to digital content not delivered on a physical medium, you agree to waive your right of withdrawal for such digital content to be served as soon as possible.
If all or part of the order relates to the provision of services, you waive your right of withdrawal for these services to be served as soon as possible after the conclusion of the contract.
III. Events
Tournaments
General
The Antwerp Powerchair Hockey Cup (APC) is a sports competition for powerchair hockey players, organized by Antwerp Powerchairhockey Collective (APHC). All participating teams agree to abide by APHC’s rules and regulations. APHC reserves the right to modify these rules and regulations at any time without prior notice. By participating in the cup, all teams agree to the terms and conditions outlined below.
Eligibility
The APC is open to all powerchair hockey players. Each team must have a minimum of two players.
Registration
Teams can register for the cup through the APHC website. The registration fee for each team is €100.00. Participants must pay the full registration amount in advance upon registration. The registration deadline will open on April 30th. Teams are required to submit the names of their players during registration. If the tournament is full, you can register on a waiting list.
Payment
You can pay using one of the methods available at checkout. If you choose “bank transfer,” you legally have 30 days to complete your payment. The invoice will state the start and due dates.
Format
The cup will be played with a group stage and three rounds of cross-finals. Each team is guaranteed to play six matches, unless there are fewer than 16 teams. All matches will be played in accordance with IPCH rules and regulations. Any rule changes will be communicated to you before the tournament.
Equipment
Each team must bring their own powerchairs and sticks. APHC will provide the game balls.
Code of Conduct
All players must behave in a sportsmanlike manner during the cup. Any form of unsportsmanlike conduct, including verbal or physical abuse, will not be tolerated. APHC reserves the right to disqualify any team or player for violating the code of conduct. Drugs and alcohol abuse are not allowed.
Failure to provide requested information by the deadline (via Google Form or email) may result in disqualification. Do not encourage teammates to buy a spot for our event at the same time as you do, as this can take a spot from another team who wishes to participate and may lead to disqualification.
Liability
APHC is not liable for any injuries or damages that may occur during the tournament. We will use insurance for physical injuries for every player.
Photography and Filming
APHC reserves the right to use photographs and videos of the tournament for promotional purposes. All participating teams agree to allow APHC to use photographs and videos of their team for promotional purposes.
Miscellaneous
APHC will not provide accommodation or travel arrangements for participating teams.
Non-refundable Policy
The Antwerp Powerchair Hockey Cup (APHC) has a strict no-refund policy. Registration falls under the services referred to in Art. VI, 53, 12° WER, for which the right of withdrawal is excluded.
Once a team has registered and paid the registration fee, the fee is non-refundable under any circumstances. This includes team cancellations, withdrawal from the tournament, or any other unforeseeable circumstances that may prevent a team from participating.
APHC invests considerable effort and resources in organizing the tournament, and the registration fee covers these costs.
However, we offer an alternative: you can offer your registration for sale through our organization by sending an email to info@aphcollective.be. If and when we find a new candidate team to participate, you will receive a refund. This refund is strictly conditional on finding a replacement team.
In case APHC cancels the event (except in cases of force majeure), registration will be automatically transferred to the new date or the next edition of the event. Any other costs incurred in connection with the event, such as service and administration fees, and any extras (e.g., merchandising, T-shirts, training schedule, charity donations), will not be refunded.
Camps
Registration
Registration for our camps is done via a form. After a certain period, we will select players who may participate in the camp based on quality, game insight, and English proficiency. If you are selected, we will officially inform you by email. You will then receive instructions on how to create your invoice and pay for your camp participation.
Cancellation Policy
If you need to cancel, please notify us by email at info@aphcollective.be.
- If you cancel within 14 days of receiving the invoice or registering for the camp, you do not have to pay a cancellation fee.
- If you cancel more than 10 weeks before the camp, the cancellation is free.
- If you cancel more than 30 days before the camp starts, you must pay 25% of the invoice amount.
- If you cancel more than 8 days before the camp starts, you must pay 50% of the invoice amount.
- If you cancel less than 8 days before the camp starts, you must pay 100% of the invoice amount.
Image Permission
When you participate in Antwerp Powerchair Hockey Collective VZW events, please be aware that photographs and videos may be taken. These images and recordings are used for various purposes, including promoting our activities, celebrating our community, and documenting the fun and excitement of our events.
By taking part in our events, you automatically grant Antwerp Powerchair Hockey Collective VZW the right to capture and use footage of you and your participation. This includes, but is not limited to, photos and videos published on our website, social media channels, promotional materials, and in reports or presentations about our work.
We strive to create a positive and inclusive environment, and any footage captured will be used respectfully and in line with our values. If you have any concerns or questions regarding this policy, please don’t hesitate to speak with an Antwerp Powerchair Hockey Collective VZW representative.
IV. Additional Provisions
1. Data Protection
We will keep records of your transactions, including purchase orders and invoices, in our computer systems under reasonable security conditions.
We guarantee the protection of your personal data in accordance with our Privacy Policy, available on our website.
2. Force Majeure
If we are fully or partially prevented from fulfilling an order due to an unforeseen circumstance beyond our control (force majeure), we have the right to suspend the execution of the order in whole or in part for the duration of the force majeure event. We will inform you immediately if this occurs.
If the force majeure continues for more than 90 days without interruption, either party has the right to unilaterally terminate the contract by registered letter to the other party. Services already performed by us will be invoiced to you on a pro-rata basis.
3. Independence of Provisions
If one or more provisions of these GTC are declared illegal or null and void, the remaining provisions will remain in full force and effect. The illegality or partial or total invalidity of any provision of these GTC will not affect the validity and application of the other provisions.
We reserve the right to replace any unlawful or invalid provision with another valid provision of similar effect.
4. Applicable Law and Competent Jurisdiction
These GTC are governed by Belgian law.
In case of a dispute where an amicable settlement cannot be reached, the dispute will be submitted to the courts of the judicial district of Antwerp (Antwerp – Turnhout – Mechelen), Belgium.
